CCRB Confidentiality Breach

July 1, 2015

Several weeks ago, the DEA discovered that CCRB released personnel records, specifically the CCRB histories, of numerous members of the Department. Such release was clearly a violation of our members’ rights under the law.

We immediately had our attorneys contact both the CCRB and the NYPD Legal Bureau and demand that the DEA be provided the names of our members whose information was released and to whom. DCLM has advised they will comply with our request, and will adopt the following procedure to ensure no further violation of our members’ confidentiality occurs.

Notices will be sent to the members concerned at their commands through their Administrative Lieutenant. This notice will notify members that their personnel information may have been disclosed and will ask them to sign a release allowing Legal to speak with DEA Counsel about this matter.

We encourage our members who receive such notice to sign the form so that our attorneys can ensure your rights are protected. The DEA will continue to work with our attorneys and Legal to ensure no further violations occur, and that our members’ personal information is treated with the concern and respect it deserves.

We encourage our members to sign the release, and RETURN IT TO THE ADDRESS LISTED ON THE FORM. You may send a copy to Attorney James Moschella at Karasyk & Moschella at (212) 233-3800. However, please include a cover note, your full name, your telephone number and send it to the attn: Joanne.
